This is one of those "Look for one thing and find something interesting on another matter."
C. Valerius Flaccus, compelled by PM Licinus to become the flamen Dialis in 209 (Livy 27.8.4-10; Val. Max. 6.9.3) was later to become a praetor in 183. In the the assignment of provincia (areas of responsibility while in office, not the province they would then govern) special arrangements had to be made. The assignment between magistrates of equal rank was done by drawing lots, and we are told that in this instance a special arrangement was made so that Valerius Flaccus would draw a lot that would allow him to remain in Rome (Livy 39.45.4).
By Merula's time, 87 BCE, such formalites were not always carried out, but the proscription requiring he remain in the City did.
